After the Russia-Ukraine conflict, the EU launched the largest sanctions program in history. Starting from October 1, 2023, EU Customs will strictly inspect all goods containing metals with declared HS codes of 7323, 7326, etc. According to the relevant requirements of the EU’s “Embargo Regulations”, if any steel products need to be sold in the EU market, they must provide a certificate of origin. All metal-related products from importing countries must provide an MTC (Material Transfer Certificate) certificate to prove the source of the product materials. Not from Russia.

What is an MTC certificate?

The full name of MTC is Mill test certificate, also known as factory test certificate or material quality certificate. It is a quality assurance document used in the metal industry to prove the chemical and physical properties of the material and indicate that it is made of metal (steel, aluminum, Brass or other alloys) comply with specific standards of international standards organizations (such as ANSI, ASME, etc.).
EU MTC certification is also called EN 10204 certification, also called pressure-bearing material certification. Mainly a traceable source of metals and steels.
For pressure-containing component materials and accessories welded directly to the pressure-containing components of pressure equipment of all risk levels, the pressure equipment manufacturer must ensure traceability by requesting a declaration of conformity from the material manufacturer.

How to deal with the new customs clearance regulations?

1) When applying for an MTC certificate, please note that the testing agency will specifically indicate the source of the material on the certificate. (It is recommended that relevant companies make clear requirements with the testing agency when applying for an MTC certificate to ensure that it does not originate from Russia and ensure the validity of the certificate)

2) According to regulations, for goods containing metals such as HS codes 7323 and 7326, the relevant MTC certificate must be provided. If the MTC certificate cannot be provided, the declared HS code needs to be changed to comply with the regulations.

3) In addition, enterprises need to pay attention to the latest announcements and policy changes from the customs and adjust relevant operations in a timely manner to ensure smooth customs clearance of goods.

Warm reminder: For products that do not declare HS codes containing metal such as 7323, 7326, etc., and whose product names do not clearly reflect the metal material, but actually contain metal accessories (such as brackets, remote control toys, etc.), there is no need to provide an MTC certificate during customs clearance. However, if there is customs inspection, an MTC certificate must be submitted.
